Privacy

Your information will be kept confidential throughout the Employer Assistance and Recruiting Network’s (EARN) job posting and matching processes. Information is kept in a secure database and will not be shared with other entities, including federal agencies, employment service providers, or other companies, without prior consent from an employer. General employment service provider contact information may be given to employers or jobseekers.

EARN is committed to maintaining the privacy of your personal information and the security of our computer systems. With respect to the collection, use and disclosure of personal information, EARN shall comply with applicable federal law, including the Privacy Act of 1974, the Paperwork Reduction Act of 1995, and the Freedom of Information Act.

As a general rule, EARN does not collect personal information about you when you visit the EARNWorks website. If you visit the website to read or download information, EARN only identifies the following:

  • The name of the domain from which you access the Internet
  • The date and time you access EARNWorks
  • The Internet address of the website from which you linked directly to EARNWorks

The above information is used by software programs on EARNWorks to create summary statistics which allow EARN to assess the number of visitors to the different sections of EARNWorks; identify what information is of most and least interest; determine technical design specifications; monitor system performance; and assist EARN in making EARNWorks more useful for visitors.

If you identify yourself by sending an email containing personal information, you may include personally-identifying information, such as your mailing address, requesting information to be snail mailed to you. Information collected in this manner is used solely for responding to requests for information or records. As such, EARN may forward your email to government employees who are better able to respond to your request.

EARN may use your personally-identifying information to provide you with any services to which you may subscribe, and any ancillary matters including the collection of any subscription or use fees, and/or for notifying you or contacting you with regard to any change in or problem with such services. EARN may therefore be required to disclose personally-identifying information to one or more EARN agents and/or contractors and/or their subcontractors; provided, however, that in such event any such agents, contractors, and subcontractors shall be required to agree to comply with EARN’s then-existing privacy policy regarding use of personally-identifying information.

Personally-identifying information may also be disclosed to the proper authorities in special cases where EARN has reason to believe that doing so is necessary to identify, contact or bring legal action against anyone damaging, injuring, or interfering (intentionally or unintentionally) with any of EARN's rights, property, interests, users, or anyone else who may be harmed by such activities. EARN may further reveal personally-identifying information when required to do so by legal process or law enforcement personnel, or at any time when EARN shall have good faith reason to believe that the law requires EARN to do so.

The EARNWorks website has several links to other websites. When you link to any of these websites, you are no longer on EARNWorks and are subject to the privacy policy of the new website.

EARN reserves the right to change its privacy policy at any time and from time to time by posting revisions on the EARNWorks website. The foregoing privacy policy does not, and is not intended to, create any contractual or other legal rights, title or interests in or on behalf of any party, and the language hereof should not be relied upon by any party as forming the basis of any contractual or legally binding agreement.

The Employer Assistance and Recruiting Network (EARN) is a nationwide cost-free recruiting and consultation service that provides employers with workforce solutions. EARN connects employers with a national network of employment service providers with access to jobseekers. As the venue linking employers to service providers and their clients, EARN does not participate in any way in the actual discussions and transactions between employers and service providers/jobseekers. Consequently EARN does not (1) investigate, evaluate or warrant the accuracy of job information posted by employers; (2) investigate, evaluate or warrant the financial capability or integrity of either employers or service providers; (3) investigate, evaluate or warrant the accuracy of the integrity of jobseeker information.

It is the responsibility of employers to review jobseekers’ information and qualifications. It is likewise the responsibility of service providers and jobseekers to evaluate the requirements, financial integrity or condition of prospective employers before referring jobseekers for employment opportunities. In no event will EARN, or any representatives, employees or subcontractors thereof, assume any liability to any third-parties for any economic damages, personal injuries or property damages incurred by any third-party that may arise, either directly or indirectly, from any use of this service. Nor shall those parties be responsible for any errors, omissions, or damages arising out of the use of communication.

EXCEPT TO THE EXTENT OTHERWISE PROVIDED HERERUNDER, EARN SHALL NOT BE LIABLE TO ANY PARTY FOR ANY INDIRECT, SPECIAL, RELIANCE, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS OR REVENUES, AS A RESULT OF ANY PARTY’S USE OF THE EARNWORKS WEBSITE AND THE SERVICES OFFERED THEREUNDER.
